I have to apply for GATE 2013, forms will be filled in Sept 2012, if I get a backlog in 5th semester then it will be cleared in February 2013, then will I be eligible to appear in GATE 2013?

Yes, you are eligible for GATE as there is no such requirement for GATE. Only after GATE result you need to pass B.Tech. to get admission in M.Tech.
